KYTTY PRIZE DRAW TERMS

1. About us 

• • The promoter is Kytty Ltd, a company registered in England and Wales with registered number 16147394 and registered office at Cambridge House, 16 High Street, Saffron Walden, Essex, CB10 1AX (KYTTY, we, us, our).

• Before an individual enters a prize draw promoted by KYTTY, they can find everything that they need to know about us and our prize draws on our website https: (Website) and the KYTTY app (once this is available to download) (App) (the Website and the App are together referred to as the Platforms) or by contacting our team by email: ask@.

1. Types of prize draw

• • We intend to hold a prize draw at the end of a defined promotion period (Promotion Period) which will be known as the “Mega Draw”, following which a combination of cash and/or lifestyle prizes will be awarded.

• • We may also hold the following prize draws, which will be announced as set out in section 2 and section 3.3 below:

• • • Bonus Draws: Extra prize draws which may be held throughout the Promotion Period at our discretion leading up to the Mega Draw. For more details, please see section 1 below; and

• • • Exclusive Subscriber Draw: Additional prize draws, specifically for qualifying subscribers, which may be conducted at our discretion during the Promotion Period before the Mega Draw. For more details, please see section 2 below.

• • In these terms, the Mega Draw, Bonus Draws (if any) and Exclusive Subscriber Draws (if any) are each referred to as a Prize Draw and collectively as Prize Draws.

• • The composition of the Prize Draws for each Promotion Period is at our discretion and can differ from one Promotion Period to another.

1. Terms and conditions

• • These Prize Draw Terms apply to every Prize Draw on the Platforms.

• • For each Promotion Period, we will outline the Promotion Specific Terms, which are specific additional terms and conditions for each of the Prize Draws to be held during Promotion Period on the Platforms. In the case of a Bonus Draw or Exclusive Subscriber Draw, this will only be to the extent that these details are fixed at the time of publication of the Promotion Specific Terms. In each case, this may include the unique identifier for the relevant draw(s), additional eligibility criteria, draw frequency, prize details, and how the draws will be conducted.

• • Where details of a Bonus Draw or Exclusive Subscriber Draw are announced during the Promotion Period, we will make an announcement on the Platforms and by email to confirm the full details of that draw, including any specific additional terms and conditions which may apply (Bonus Announcement).

• • These Prize Draw Terms must be read together with each of the following:

• • • the Promotion Specific Terms, which are referenced using the unique identifier applicable to the relevant Promotion Period;

• • • any Bonus Announcement, referenced using the unique identifier applicable to the relevant Bonus Draw or Exclusive Subscriber Draw;

• • • our Website Terms of Use and Acceptable Use Policy;

• • • our Privacy Policy;

• • • our Cookies Policy; and

• • • (if you are a subscriber to our Platforms) the Subscriber Terms,

which, together with these Prize Draw Terms, are referred to as the Governing Documents and form the contract between a Participant and KYTTY for the use of the Platforms and participation in any Prize Draw.

• Every person who enters a Prize Draw on the Platforms (Participant or you) is deemed to have accepted and agreed to be bound by the Governing Documents upon entry. If you do not agree with any of the Governing Documents, please do not use the Platforms.

• KYTTY reserves the right to update or amend any of the Governing Documents as it considers necessary. The date and version number of each Governing Document will be set out at the start of the relevant document on the Platforms.
•  
• If we consider it necessary to change any of the Promotion Specific Terms or Bonus Announcements during the Promotion Period, this will only be in exceptional circumstances and we will publish details of any changes or supplemental rules on the Platforms.

4. Eligibility 

• • Entry into any Prize Draw is only open to residents in the UK aged 18 years or over, except:

• • • employees, officers and/or shareholders of KYTTY or its holding or subsidiary companies;

• • • employees of agents or suppliers of KYTTY or its holding or subsidiary companies, who are professionally connected with the administration of a Prize Draw or Promotion Period in any way; and/or

• • • members of the immediate families (meaning spouse, civil partner, child (including adopted and step children), parent (including legal guardians) or sibling) of (a) and (b) above or individuals residing at the same residential address as (a) and (b) above.

• • In entering a Prize Draw, you confirm that you are eligible to do so and eligible to claim any prize you may win.

• • KYTTY may require you to provide proof that you are eligible to enter the relevant Prize Draw.

• • KYTTY will not accept entries (whether electronically or by post) that are:

• • • completed by third parties;

• • • completed or submitted in bulk or mechanically;

• • • automated and submitted by computers, software and/or artificial intelligence;

• • • submitted on behalf of another person;

• • • submitted by one person using multiple email addresses;

• • • joint entries;

• • • illegible, damaged, forged or tampered with;

• • • in the case of any postal entry, entries for multiple Participants using just one correct postage; or
  • Any postal entry submitted in accordance with section 6.5(b) or section 6.7(b):

• • • for which the correct postage has not been paid;

• • • which does not clearly set out on the back of the postcard (without an envelope) or on the outside of the envelope, the name and unique identifier of the Mega Draw or Exclusive Subscriber Draw that the Participant would like to enter; or

• • • which is included in the same envelope with an eligible entry (the first entry in the envelope being the eligible entry),

is ineligible and will not be entered into the relevant Prize Draw.

• Any postal entry submitted in accordance with section 5(b) or section 6.7(b) which is received and entered into a Prize Draw, but when inspected by an independent person appointed by KYTTY in accordance with section 8.3:

• • is ineligible in accordance with this section 4, including by way of any non-compliance with section 4;
• • is not legible; and/or
• • does not include all of the required information (as set out in section 5(b) or section 6.7(b)),

will be deemed to have been ineligible and deemed to be void for any Mega Draw, associated Bonus Draws and/or any Exclusive Subscriber Draw in which that postal entry has participated or was intended to participate.

• Any limits on entry which apply to a Prize Draw will be set out in the Promotion Specific Terms or Bonus Announcements applicable to that Prize Draw.
• If there is any reason to believe that there has been a breach of any of the Governing Documents, including these eligibility requirements, we reserve the right, at our sole discretion to refuse your entry to a Prize Draw, to exclude you from participating in any Prize Draw and/or to refuse to award the relevant prize to you.

5. Bonus Draws and Exclusive Subscriber Draws

5. • Participants who have made an entry which is eligible (as determined in accordance with these Prize Draw Terms) for the Mega Draw in a Promotion Period, will automatically be entered into any Bonus Draws that we offer during the remainder of that Promotion Period. Other than a valid entry into the Mega Draw, no purchase is necessary in relation to a Bonus Draw.
6. • Any Exclusive Subscriber Draws that we offer during a Promotion Period will be free to enter for Subscribers who meet the qualification criteria set out in the relevant Promotion Specific Terms or Bonus Announcement. (Qualifying Subscriber) In addition, there will be a free postal entry route for anyone who is not a Qualifying Subscriber.
7. • We will announce full details of any Bonus Draws or Exclusive Subscriber Draws on the Platforms by way of the Bonus Announcement and/or in the Promotion Specific Terms applicable to that Promotion Period.

5. How to Participate

• • Each Promotion Period will run from and to the dates set out in the in the Promotion Specific Terms and/or relevant Bonus Announcement applicable to that Promotion Period.
• • The Promotion Specific Terms applicable to a Promotion Period and/or relevant Bonus Announcement will set out the opening date for each Prize Draw (each an Opening Date) and the closing date for each Prize Draw (each a Closing Date) during that Promotion Period.
• • There are a number of ways to enter a Prize Draw, depending on the type of Prize Draw. In each case, there is a method of entry where the Prize Draw is free to enter and no purchase is necessary.
• • All entries must be received by KYTTY by no later than the Closing Date for the relevant Prize Draw. All entries received after that Closing Date are automatically disqualified.
• • To enter a Mega Draw:

• • • On the Platforms: A Participant can purchase entries on our Platforms to enter a Mega Draw during the relevant Promotion Period and up to the Closing Date set out in the Promotion Specific Terms for that Mega Draw (Paid Entry). A Participant who is eligible and has successfully paid for a Paid Entry will be entered into the Mega Draw from the date of successful payment for the number of entries paid for by them.
  • • By Post: A Participant can send a letter or postcard which legibly sets out:

• • • • their full name,
    • • address,
    • • email address, and
    • • the name and unique identifier of the Mega Draw that they would like to enter,

by first or second class post to the name and address set out in the relevant Promotion Specific Terms (Postal Entry). A Participant may also include their telephone number as an additional way for KYTTY to contact them, but this is not an entry requirement.

The Postal Entry must be received on or before the relevant Closing Date. The date of receipt of the Postal Entry will be logged. Any entries received after 5.00pm (UK time) will be marked as received on the next day. No confirmation of receipt shall be given for any Postal Entry.

Any Postal Entry for which the correct postage has not been paid will be ineligible and deemed to be void. A Participant from whom KYTTY has received an eligible Postal Entry on or before the Closing Date will be entitled to one entry into the Mega Draw per Postal Entry.  All Postal Entries selected as Potential Winners (in accordance with section 8) will be subject to the initial verification checks set out in section 8.3, in addition to the general verification checks in section 9.3.

• By subscription: A Participant who has been accepted by KYTTY as a subscriber (Subscriber) will be entered into any Mega Draws with a Closing Date on or after the date of their subscription for such time as they continue to be a Subscriber in accordance with the Subscriber Terms. The number of entries and the date from which a Subscriber will enter Mega Draws will be calculated in accordance with section 7 of the Subscriber Terms.

• To enter a Bonus Draw:

• • A Participant who has successfully made a Paid Entry on or before the Closing Date set out in the Promotion Specific Terms for that Mega Draw will automatically be entered into any Bonus Draws which take place during the remainder of the Promotion Period and for which the Closing Date falls after the date of the Paid Entry into the Mega Draw. The number of entries for each Bonus Draw will reflect the number of entries paid for by them as part of the Paid Entry.
• • Unless you tell us that you do not wish to participate, a Participant who has made a Postal Entry which is received on or before the Closing Date set out in the Promotion Specific Terms for that Mega Draw, will automatically be entered into any Bonus Draws which take place during the remainder of the relevant Promotion Period and for which the Closing Date falls after the date of receipt of their Postal Entry. Any Postal Entries received after 5.00pm (UK time) will be marked as received on the next day. A Postal Entry entitles a Participant to one entry per Bonus Draw during the remaining Promotion Period.

Any Postal Entry for which the correct postage has not been paid will be ineligible and deemed to be void. All Postal Entries selected as Potential Winners (in accordance with section 8) will be subject to the initial verification checks set out in section 8.2, in addition to the general verification checks in section 9.3.

• A Subscriber will be entered into any Bonus Draws with a Closing Date on or after the date of their subscription for such time as they continue to be a Subscriber in accordance with the Subscriber Terms. The number of entries and the date from which a Subscriber will enter Bonus Draws will be calculated in accordance with section 7 of the Subscriber Terms.
• If you do not wish to be entered into a Bonus Draw, please contact KYTTY by email at info@.

• To enter an Exclusive Subscriber Draw:

• • By subscription: A Qualifying Subscriber will be entered into any Exclusive Subscriber Draws which take place with a Closing Date on or after the date of their subscription for such time as they continue to be a Subscriber in accordance with the Subscriber Terms. The number of entries and the date from which a Subscriber will enter Exclusive Subscriber Draws will be calculated in accordance with section 7 of the Subscriber Terms.
• • By Post: A Participant can send a letter or postcard which legibly sets out:

• • • their full name,
  • • address,
  • • email address, and
  • • the name and unique identifier of the Exclusive Subscriber Draw that they would like to enter,

by first or second class post to the name and address set out in the relevant Promotion Specific Terms or Bonus Announcement (Exclusive Subscriber Draw Postal Entry). A Participant may also include their telephone number as an additional way for KYTTY to contact them, but this is not an entry requirement.

The Exclusive Subscriber Draw Postal Entry must be received on or before the relevant Closing Date for that Exclusive Subscriber Draw. The date of receipt of the Exclusive Subscriber Draw Postal Entry will be logged. Any entries received after 5.00pm (UK time) will be marked as received on the next day.

An Exclusive Subscriber Draw Postal Entry for which the correct postage has not been paid will be ineligible and deemed to be void. A Participant from whom KYTTY has received an eligible Exclusive Subscriber Draw Postal Entry on or before the Closing Date, will be entitled to one entry into the relevant Exclusive Subscriber Draw per Exclusive Subscriber Draw Postal Entry.

All Exclusive Subscriber Draw Postal Entries selected as Potential Winners (in accordance with section 8) will be subject to the initial verification checks set out in section 8.3, in addition to the general verification checks in section 9.3.

• KYTTY will not accept:

• • responsibility for entries that are corrupted, not successfully completed or transmitted, lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, app, website, computer hardware or software failure of any kind; or\
• • proof of posting or transmission as proof of receipt of the entry to the Prize Draw.
• KYTTY is under no obligation to acknowledge receipt of a Postal Entry or an Exclusive Subscriber Draw Postal Entry.

7. The prizes 

7. • Details of the nature and number of any prizes or gifts that are available to be won for each Prize Draw will be set out in the Promotion Specific Terms applicable to that Prize Draw and/or the Bonus Announcement.
8. • Any prize is non-exchangeable and non-transferable.
9. • KYTTY reserves the right to replace a prize with an alternative prize of equal or higher value if circumstances beyond KYTTY’s control makes it necessary to do so.
10. • Where the prize is a non-cash prize (which includes vouchers, or equivalent credit with a supplier):

• • • Prizes are subject to availability.
  • • There is no right to demand a cash alternative.
  • • KYTTY reserves the right to substitute the prize with a prize of equal or greater value.
  • • Prizes are subject to the terms and conditions of the third party provider, a copy of which will be provided to the winner.
  • • KYTTY will confirm arrangements for collection or delivery and timing to the winner.
  • • The Promotion Specific Terms and/or the Bonus Announcement relevant to that prize will set out the timing and logistics for collection of the prize and any other restrictions or limitations which apply.

• • Where the prize is a vehicle:

• • • Prizes are subject to availability.
  • • KYTTY reserves the right to substitute the prize with a prize of equal or greater value.
  • • There is no right to demand a cash alternative.
  • • Prizes are subject to the terms and conditions of the third party provider or manufacturer, a copy of which will be provided to the winner.
  • • Unless offered by KYTTY in relation to a specific vehicle, the prize does not include vehicle or road tax and it is the responsibility of the winner to arrange this.
  • • The prize does not include insurance and it is the responsibility of the winner to arrange this.
  • • A winner must have a valid driving licence.
  • • The prize may not be claimed by a third party on behalf of the winner.
  • • The Promotion Specific Terms and/or the Bonus Announcement relevant to that prize will set out the timing and logistics for collection of the vehicle and any other restrictions or limitations which apply.

• • Where the prize is cash:

• • • Payment may be made by cheque, bank transfer or direct debit and KYTTY will confirm which method will be used and timing for payment to the winner.
  • • The Promotion Specific Terms will set out any other restrictions or limitations which apply.

• • In order to claim some or all of the prize a potential winner must follow the process set out in section 9.

7. Winners 

• • For each Prize Draw:

• • • the number of potential winners will be set out in the Promotion Specific Terms or the relevant Bonus Announcement (as the case may be);
  • • all Participants who have entered using the KYTTY Platforms are assigned a unique identifier which will be entered into the relevant Prize Draw as many times as necessary depending on the number of entries for that Participant; and
  • • all postal entries are assigned a unique identifier,

and these identifiers are then used in a random draw performed by an independent third party, on the date set out in the Promotion Specific Terms applicable to that Prize Draw (Draw Date). The random draw will pick a potential winner or winners (each a Potential Winner).

• KYTTY will endeavour to publish the unique identifier relating to the Potential Winner(s) by the Announcement Date set out in the Promotion Specific Terms or Bonus Announcement.
• Where the Potential Winner has entered by Postal Entry or Exclusive Subscriber Draw Postal Entry, KYTTY will appoint an independent person to make an initial assessment of a Potential Winner’s eligibility (including the eligibility of any Postal Entry or Exclusive Subscriber Draw Postal Entry) in accordance with section 4. If the Potential Winner or the entry of that Potential Winner is not eligible, then that Potential Winner’s entry will be void, any prize forfeited and KYTTY will be entitled to select another potential winner to replace them in accordance with the process described in section 1.
• If the initial assessment of a Potential Winner’s eligibility in relation to a Bonus Draw determines that the Potential Winner or the entry of that Potential Winner is not eligible, then (in addition to the consequences set out in section 8.3) KYTTY will be entitled to void any other entries which that Participant may otherwise have been entitled to make (including for the Mega Draw) for the remainder of the Promotion Period.
• If the initial assessment is successful under section 8.3, a Potential Winner will be notified by email (using details provided at the point of entry) within 48 hours of completion of the checks under section 8.3 and, if necessary, KYTTY will also subsequently attempt contact via any address or telephone number provided by the Potential Winner (Winner Notification).
• KYTTY will make reasonable efforts to contact a Potential Winner, including by emailing them up to three times and using any other contact details on a Potential Winner’s Account (if they have an Account). KYTTY will keep a record of each Winner Notification.

9. Claiming the prize

9. • A Potential Winner must respond to the Winner Notification and contact KYTTY by email at winner@ within 14 days of the first Winner Notification from KYTTY, to confirm that they would like to claim the relevant prize and to arrange their claim.
10. • If a Potential Winner does not contact KYTTY within 14 days in accordance with section 1, then that Potential Winner’s prize will be forfeited and KYTTY will be entitled to select another winner to replace them in accordance with the process described in section 8.1.
11. • Once a Potential Winner has contacted KYTTY in accordance with section 1, KYTTY will ask the Potential Winner to provide identification (for example a certified copy of a passport and/or photocard driving licence and two utility bills dated within the last 3 months) and such other information as is necessary to prove the identity of the Potential Winner and their eligibility for the relevant Prize Draw. This may include the Potential Winner undertaking online identity verification and/or KYTTY carrying out identity checks on the Potential Winner.
12. • KYTTY may refuse to pay a prize where the Potential Winner is unwilling or unable to provide such information or is not able to prove the identity of the Potential Winner. In this case, the Potential Winner’s prize will be forfeited and KYTTY will be entitled to select another potential winner to replace them in accordance with the process described in section 1.
13. • No interest will be payable on a cash prize.
14. • A prize may not be claimed by a third party on behalf of a Potential Winner.
15. • Once a Winner’s eligibility and identity has been established to the reasonable satisfaction of KYTTY (including in accordance with section 3 and section 9.3), they shall be confirmed as a winner (Winner) and KYTTY will liaise with the Winner to arrange payment of the prize and/or provision of the prize in accordance with the Promotion Specific Terms. Where there are multiple Winners, each Winner will be engaged with separately by KYTTY.
16. • KYTTY does not accept any responsibility if a Winner is not able to take up the prize or a Potential Winner does not respond to a Winner Notification within 14 days.
17. • A Winner is solely responsible for all taxes or other fees, expenses and charges which may result from accepting the relevant prize.
18. • KYTTY recommends that any Winner takes independent financial advice and can provide a list of suggested national providers, from which the Winner may choose. If the Winner wishes to do so, KYTTY will provide reasonable assistance in making an appointment for the Winner with their chosen provider. KYTTY does not make any recommendation on the choice of provider or give financial advice.
19. • No fees or charges are required to be paid by the Winner to claim any of the prizes.

9. Publicity

9. • KYTTY will always seek a Winner’s consent to make substantive use of a Winner’s details in publicity.
10. • KYTTY must either publish or make available information that indicates that a valid award took place. To comply with this obligation KYTTY will publish the surname and county of Winners in a list of winners on the Platforms after the Draw Date stated in the Promotion Specific Terms and may email those details to others entered into the Prize Draw (unless you object under section 10.3).
11. • If you are a Winner and you object to any or all of your surname, county and winning entry being published or made available, please contact KYTTY by email at winner@. In such circumstances, KYTTY must still provide the information and winning entry to the Advertising Standards Authority on request

9. Limitation of liability

• • Nothing in these Prize Draw Terms limits or excludes liability for death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation or any other liability that cannot legally be limited.
• • Insofar as is permitted by law, KYTTY, its agents or distributors will not in any circumstances be responsible or liable to compensate any winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up any prize except where it is caused by the negligence of KYTTY, its agents or distributors or that of their employees. Your statutory rights are not affected.
• • Insofar as is permitted by law, KYTTY accepts no liability to any person (including but not limited to any responsibility for entries not successfully completed or responsibility for the non-payment of a prize) due to:

• • • any failure or delay of the postal system regardless of cause, including delays, losses, damage or mistakes;
  • • any failure of the banking system regardless of cause;
  • • any technical fault, technical malfunction, equipment failure, systems, satellite, network, app, server or website failure of any kind;
  • • any event outside our control, such as war or threat of war, acts of terrorism, pandemic, epidemic, flood, drought, or other natural disaster, collapse of buildings, fire, explosion or accident, or interruption or failure of utility or telecommunications services;
  • • something you could have avoided by taking reasonable action. For example, failure to keep your password or log-in details secure, the failure or malfunction of your own digital device or equipment, the failure or malfunction of your own internet or telecommunications connectivity, failure to keep your contact details up to date or any failure to respond to our communications.

12. Data protection

12. • Personal data supplied in relation to any Prize Draw will only be processed as set out in KYTTY’s Privacy Policy.
13. • See also section 10 (Publicity) with regard to the announcement of Winners.

12. General 

• • The decision of KYTTY regarding any aspect of a Prize Draw will be final and binding and no correspondence will be entered into about it.
• • We reserve the right to hold void, cancel, suspend, or amend any Promotion Period or Prize Draw where it becomes necessary to do so.
• • We can transfer our contract with you, so that a different organisation is responsible for becoming the promoter of the Prize Draws. We will tell you in writing if this happens and we will ensure that the transfer does not affect an ongoing Promotion Period.
• • You cannot transfer your rights under these Prize Draw Terms or your Account with us to anyone else.
• • No person, other than the named Participant, has any rights under or to enforce these Prize Draw Terms or any other Governing Document.
• • If a court invalidates some of these Prize Draw Terms, the rest of the terms will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.
• • Even if we delay in enforcing our rights under these Prize Draw Terms or any other Governing Document, we can still enforce our rights later.

The Governing Documents and each Prize Draw are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country
